1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Hi Luna LLC ("Hi Luna," "we," "us," or "our"), a Colorado limited liability company. By signing up for, accessing, or using Hi Luna's services, you agree to be bound by these Terms.

2. Description of Services
Hi Luna provides AI-powered phone answering services designed for trade businesses including plumbers, HVAC technicians, electricians, and other service professionals. Our services include:
- 24/7 AI phone answering via a dedicated local phone number (one number per subscription)
- Automated lead qualification and appointment booking
- Email notifications to the business owner for each booking and Google Calendar event creation
- Call recording for quality assurance
- Integration with your existing scheduling workflow
Hi Luna operates as a technology intermediary. We are not a staffing agency and do not employ human receptionists.
3. Payment Terms
Hi Luna operates on a subscription model with the following pricing tiers:
- Starter: $149/month (52 calls included; $5.99/additional call)
- Growth: $249/month (87 calls included; $3.99/additional call)
- Pro: $499/month (175 calls included; $2.49/additional call)
- Enterprise: $10,000+/month (unlimited calls, fully custom)
Monthly subscription fees are billed at the start of each billing cycle. Overage charges are billed at the end of the cycle based on actual call volume.
Payments are processed via PayPal. By providing payment information, you authorize Hi Luna to charge your PayPal account on a recurring monthly basis. All charges are in U.S. dollars.
4. Cancellation Policy
You may cancel your Hi Luna service at any time by:
- Emailing hello@hilunax.com with "Cancel" in the subject line
- Calling us at (720) 613-2599
There are no contracts, no minimum commitments, and no cancellation fees. Cancellation takes effect immediately upon confirmation from our team. Your dedicated phone number will be deactivated within 24 hours of cancellation.
5. Refund Policy
Hi Luna is committed to fair billing practices:
- Within 10 days of initial signup: Full refund of any charges if you are not satisfied, no questions asked.
- Day 11 and after: The money-back guarantee no longer applies. You can cancel any time and you will not be billed for the next month, but charges already made are non-refundable.
- Disputed bookings: If you believe a charge was made in error (e.g., AI booked a duplicate appointment or a test call), contact us within 7 days and we will review and refund if appropriate.

6. Data Usage and Call Recordings
By using Hi Luna, you agree to the following data practices:
- Call recordings: All calls handled by Hi Luna are recorded for quality assurance, training, and dispute resolution purposes. Recordings are stored for 90 days.
- Customer data: Information collected during calls (caller name, phone number, address, service requested) is used solely to provide the Hi Luna service and deliver booking confirmations to you.
- Caller notification: You are responsible for ensuring callers are informed that calls may be recorded, as required by applicable state law. Hi Luna's AI plays a brief disclosure ("This call may be recorded for booking accuracy") in its first sentence on every inbound call. By continuing the call after Luna's introduction, callers consent to the recording.
- No sale of data: Hi Luna does not sell caller or customer data to third parties.

7. Acceptable Use
You agree to use Hi Luna's services only for legitimate business purposes. You may not:
- Use the service for illegal, fraudulent, or deceptive purposes
- Attempt to manipulate the AI system to generate false bookings
- Resell or sublicense the service without written permission from Hi Luna
- Use the service in ways that violate applicable telemarketing, TCPA, or consumer protection laws
8. Limitation of Liability
Hi Luna's services are provided "as-is" and "as available" without warranties of any kind, express or implied. Specifically:
- Hi Luna does not guarantee that every call will be answered or that every caller will book an appointment.
- Hi Luna is not responsible for missed business opportunities resulting from technical outages, caller hang-ups, or AI limitations.
- Hi Luna does not guarantee the accuracy of information captured during AI calls and is not responsible for errors in booking details.
- In no event shall Hi Luna's total liability to you for any claim exceed the total amount you paid to Hi Luna in the calendar month preceding the claim.
Hi Luna shall not be liable for any indirect, incidental, special, or consequential damages.
9. Service Availability
Hi Luna aims for maximum uptime but does not guarantee uninterrupted service. Planned maintenance will be communicated via email when possible. Hi Luna is not liable for service interruptions caused by third-party providers (including phone carriers and AI infrastructure providers).
10. Intellectual Property
Hi Luna retains all rights to its AI technology, software, branding, and systems. You retain ownership of your business information, caller data, and any content you provide to Hi Luna.
11. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Boulder County, Colorado.
12. Changes to Terms
Hi Luna may update these Terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the service after changes constitutes acceptance of the updated Terms.
